Terms and Conditions
for orders at Rudelwohl
1. Scope
1.1 These terms and conditions of "M. Marquardt" (hereinafter "Seller") apply to all contracts concluded between a consumer or entrepreneur (hereinafter "Customer") and the Seller regarding the goods and/or services displayed by the Seller on its online shop or communication platforms. The inclusion of the Customer's own terms and conditions is hereby objected to, unless otherwise agreed.
1.2 A consumer within the meaning of these General Terms and Conditions is any natural person who enters into a legal transaction for purposes that predominantly are outside their trade, business or profession. An entrepreneur within the meaning of these General Terms and Conditions is a natural or legal person or a partnership with legal capacity who, when entering into a legal transaction, acts in exercise of their trade, business or profession.
2. Conclusion of Contract
2.1 The product representations on the website or on the Seller's online communication platforms do not constitute binding offers by the Seller but serve for the Customer to submit a binding offer.
2.2 The Customer can place an order via the online shop on the website, by contacting via email at rudelwohl@yahoo.com, or through the contact form on the website. This involves the individual customization of the desired product and communication of specific details.
2.3 Upon placing an order, the Customer automatically receives an email confirming receipt of the order ("Order Confirmation"). However, this does not yet constitute acceptance of the Customer's order by the Seller.
The Customer will be informed within five working days whether their order is accepted. In most cases, acceptance of the order occurs when the invoice is sent via email to the Customer. Additionally, dispatch of the ordered products also constitutes acceptance. The Seller will then send an email confirming that the products have been shipped ("Shipping Confirmation").
A binding contract between the Customer and the Seller, incorporating these general terms and conditions (the "Contract"), is formed earliest upon either the issuance of the invoice or the Shipping Confirmation.
2.4 The period for acceptance of the offer begins on the day after the offer is sent by the Customer and ends with the expiry of the fifth working day following the sending of the offer.
2.5 The contract language is exclusively German.
2.6 Order processing and communication typically occur via email and online communication platforms. The Customer must ensure that the email address provided for order processing is accurate and capable of receiving emails sent by the Seller. In particular, the Customer must ensure that all emails sent by the Seller or third parties appointed by the Seller for order processing can be delivered, including by adjusting spam filters accordingly.
3. Right of Withdrawal
3.1 There is no right of withdrawal for contracts for the supply of goods that are not prefabricated and for the production of which an individual selection or specification by the customer is decisive, or which are clearly tailored to the personal needs of the customer. This applies in particular to all handmade products from Rudelwohl that are individually manufactured according to customer specifications, for example through the selection of size, length, color, material, or fittings. For these custom-made products, withdrawal is excluded. The legal basis for this is Section 312g (2) No. 1 of the German Civil Code (BGB).
For pre-manufactured products, in particular items from the sale section or from stock, the statutory right of withdrawal applies. The withdrawal period is fourteen days from the day on which the customer or a third party designated by the customer receives the goods.
Withdrawal can be declared by email to rudelwohl@yahoo.com or via the online withdrawal form provided on the website in the footer under “Withdrawal”. Upon submission of the online form, the customer will receive an automatic confirmation of receipt by email.
To comply with the withdrawal period, it is sufficient to send the withdrawal declaration in time.
Regardless of this, I reserve the right, in individual cases, to agree to a return of custom-made products as a gesture of goodwill. There is no legal entitlement to this.
4. Returns
4.1 Would you like to return a product purchased from me? Please contact me via email at rudelwohl@yahoo.com. The cost of returning the goods is borne by the buyer.
5. Prices and Payment Terms
5.1 The prices stated by the seller are final prices and include statutory value added tax (VAT). Any additional delivery and shipping costs will be clearly communicated to the customer during the ordering process.
5.2 The available payment methods are displayed to the customer during the ordering process. Payment is processed via the payment service providers indicated there. Production and/or delivery will take place after receipt of payment.
