1. Scope

1.1 These terms and conditions of "M. Marquardt" (hereinafter "Seller") apply to all contracts concluded between a consumer or entrepreneur (hereinafter "Customer") and the Seller regarding the goods and/or services displayed by the Seller on its online shop or communication platforms. The inclusion of the Customer's own terms and conditions is hereby objected to, unless otherwise agreed.

1.2 A consumer within the meaning of these General Terms and Conditions is any natural person who enters into a legal transaction for purposes that predominantly are outside their trade, business or profession. An entrepreneur within the meaning of these General Terms and Conditions is a natural or legal person or a partnership with legal capacity who, when entering into a legal transaction, acts in exercise of their trade, business or profession.

2. Conclusion of Contract

2.1 The product representations on the website or on the Seller's online communication platforms do not constitute binding offers by the Seller but serve for the Customer to submit a binding offer.

2.2 The Customer can place an order via the online shop on the website, by contacting via email at rudelwohl@yahoo.com, or through the contact form on the website. This involves the individual customization of the desired product and communication of specific details.

2.3 Upon placing an order, the Customer automatically receives an email confirming receipt of the order ("Order Confirmation"). However, this does not yet constitute acceptance of the Customer's order by the Seller.
The Customer will be informed within five working days whether their order is accepted. In most cases, acceptance of the order occurs when the invoice is sent via email to the Customer. Additionally, dispatch of the ordered products also constitutes acceptance. The Seller will then send an email confirming that the products have been shipped ("Shipping Confirmation").
A binding contract between the Customer and the Seller, incorporating these general terms and conditions (the "Contract"), is formed earliest upon either the issuance of the invoice or the Shipping Confirmation.

2.4 The period for acceptance of the offer begins on the day after the offer is sent by the Customer and ends with the expiry of the fifth working day following the sending of the offer.

2.5 The contract language is exclusively German.

2.6 Order processing and communication typically occur via email and online communication platforms. The Customer must ensure that the email address provided for order processing is accurate and capable of receiving emails sent by the Seller. In particular, the Customer must ensure that all emails sent by the Seller or third parties appointed by the Seller for order processing can be delivered, including by adjusting spam filters accordingly.

 

3. Right of Withdrawal

3.1 You have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period will expire after 14 days from the day on which you acquire, or a third party other than the carrier and indicated by you acquires, physical possession of the goods.

To exercise your right of withdrawal, you must inform me, Marleen Marquardt, Straße zum Bahnhof 9, 16775 Löwenberger Land, Germany, by email to rudelwohl@yahoo.com of your decision to withdraw from this contract by an unequivocal statement (e.g. a letter sent by post or email).

You may use the attached model withdrawal form, but it is not obligatory. You can also declare your withdrawal using the online withdrawal form provided on the website in the footer under "Withdrawal". If you use this online function, I will immediately send you confirmation of receipt on a durable medium (e.g., by email) with information about the content of your cancellation notice, as well as the date and time of its receipt.

To meet the cancellation deadline, it is sufficient that you send your notification of exercising your right of cancellation before the cancellation period expires.

3.2 Consequences of withdrawal: If you withdraw from this contract, I will reimburse all payments received from you, including delivery costs (excluding any additional costs incurred if you chose a delivery method other than the cheapest standard delivery offered by me), without undue delay and at the latest within fourteen days from the day on which I received your notification of withdrawal from this contract. For this reimbursement, I will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise; in no case will you be charged any fees as a result of this reimbursement. I may withhold reimbursement until I have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest. You must return or hand over the goods to me, Marleen Marquardt, Straße zum Bahnhof 9, 16775 Löwenberger Land, without undue delay and in any event no later than fourteen days from the day on which you notify me of your withdrawal from this contract. The deadline is met if you send the goods before the fourteen-day period has expired. You bear the direct costs of returning the goods. You are only liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics, and functioning of the goods.

3.3 Exclusion and Expiry Grounds

The right of withdrawal does not apply to contracts for the supply of goods that are not prefabricated and for whose production an individual selection or specification by the consumer is decisive, or which are clearly tailored to the personal needs of the consumer.

4. Returns
4.1 Would you like to return a product purchased from me? Please contact me by email at rudelwohl@yahoo.com. The direct costs of returning the goods shall be borne by the buyer, subject to the regulations on the right of withdrawal under Section 3.

 

5. Prices and Payment Terms

5.1 The prices stated by the seller are final prices and include statutory value added tax (VAT). Any additional delivery and shipping costs will be clearly communicated to the customer during the ordering process.

5.2 The available payment methods are displayed to the customer during the ordering process. Payment is processed via the payment service providers indicated there. Production and/or delivery will take place after receipt of payment.



6. Delivery and Shipping Conditions

6.1 Goods are delivered regularly by shipping to the delivery address provided by the Customer. The delivery address provided in the Seller's purchase processing is decisive for the processing of the transaction. Delivery of the goods is initiated promptly after production. Shipping usually occurs within 20 to 30 working days, depending on the order situation. The standard delivery time from shipping is 7-14 working days. Rudelwohl sends the order as soon as all ordered products have been made. The Customer will be promptly informed of any delays. Shipping is insured.

6.2 If the transport company returns the shipped goods to the Seller because delivery to the Customer was not possible, the Customer bears the costs for the unsuccessful shipping. This does not apply if the Customer is not responsible for the circumstance leading to the impossibility of delivery or if the Customer was temporarily prevented from accepting the offered service, unless the Seller had announced the service to the Customer a reasonable time in advance.

6.3 In the case of self-collection, the Seller will inform the Customer by email that the ordered goods are ready for collection. After receiving this email, the Customer can collect the goods by appointment with the Seller at the Seller's premises. In this case, no shipping costs will be charged.



7. Warranty


7.1 The statutory warranty rights shall apply.
The warranty does not cover damage resulting from improper use, incorrect handling, insufficient care, or external influences that are not attributable to a defect in the goods. This applies in particular to damage caused by the customer or by the customer’s dog.

All products by Rudelwohl (with the exception of keychains and key straps) are intended exclusively for use with dogs. Any other use is at the customer’s own risk. The customer is responsible for assessing the suitability of the product for their dog and for using the product properly. Rudelwohl shall not be liable for damage resulting from use that is not in accordance with the intended purpose or from improper handling.


8. Indemnification for Violation of Third Party Rights

8.1 If, according to the content of the contract, the Seller owes not only the delivery of the goods but also the processing of the goods according to specific specifications of the Customer, the Customer must ensure that the content provided to the Seller by the Customer for processing does not infringe the rights of third parties (e.g., copyrights or trademark rights). The Customer shall indemnify the Seller against claims by third parties that they may assert against the Seller in connection with an infringement of their rights due to the contractual use of the Customer's content by the Seller. The Customer shall also bear the reasonable costs of the necessary legal defense, including all court and attorney fees in statutory amount. This shall not apply if the infringement is not attributable to the Customer. In case of claims by third parties, the Customer is obliged to provide the Seller promptly, truthfully, and completely with all information necessary for the examination of the claims and a defense.

9.
 Additional Provisions

9.1 All legal relationships between the parties shall be governed by the laws of the Federal Republic of Germany, excluding the laws on the international sale of goods (CISG). For consumers, this choice of law applies only to the extent that the protection afforded by mandatory provisions of the law of the state in which the consumer has their habitual residence is not withdrawn.

9.2 Place of Jurisdiction: If the customer acts as a merchant, a legal entity under public law, or a special fund under public law with their registered office within the territory of the Federal Republic of Germany, the exclusive place of jurisdiction for all disputes arising from this contract shall be the place of business of the seller. If the customer has their registered office outside the territory of the Federal Republic of Germany, the place of business of the seller shall be the exclusive place of jurisdiction for all disputes arising from this contract if the contract or claims arising from the contract can be attributed to the professional or commercial activity of the customer. However, in the aforementioned cases, the seller is in any case entitled to appeal to the court at the customer's place of business.

9.3 Alternative Dispute Resolution: The seller is neither obliged nor willing to participate in a dispute resolution procedure before a consumer arbitration board.
